Article 6 of the Indian Constitution provides for citizenship by descent. According to this provision, a person is considered a citizen of India by descent if he or she is born outside India and at least one of their parents is a citizen of India at the time of their birth.
There are certain conditions and restrictions that apply to citizenship by descent. For example, if the person’s father is a citizen of India, they can claim citizenship by descent regardless of the place of birth. However, if the person’s mother is a citizen of India, they can only claim citizenship by descent if their birth takes place in a country that does not automatically grant citizenship to children born on their soil. Additionally, the person must register themselves as an Indian citizen with the relevant Indian diplomatic mission within one year of their birth or within such further time as the Indian government may allow.
It is also worth noting that citizenship by descent is not automatically granted and the process of obtaining citizenship can be complex and time-consuming.
